Terms of Service

Effective date: 1 July 2025. These Terms of Service apply to all dining, catering, event and other food services supplied by Chilli House Pty. Ltd. (ABN 86 702 125 513) and to your use of our website at https://chillihouse.site.

1. About These Terms

In these Terms, “Chilli House”, “we”, “us” and “our” mean Chilli House Pty. Ltd. (ABN 86 702 125 513), a company providing restaurant and food services in Perth, Western Australia. “You” and “your” mean any customer, guest, event organiser or business that engages us or uses our website. “Services” means all dining, takeaway, catering, event and related food services we supply.

By placing an order, making a booking, requesting a quote or using our website, you agree to these Terms. If you do not agree, please do not use our Services. These Terms apply together with any written quote, booking confirmation or function agreement we issue to you. If there is a conflict, the signed or confirmed document prevails over these Terms for that booking.

2. Our Services

We provide restaurant and food services across Perth and surrounding areas, including:

  • Dine-in restaurant service and table bookings;
  • Takeaway and pre-ordered meals;
  • Catering for private, corporate and community events;
  • Event food service, staffing and equipment hire quoted on request; and
  • Menu planning and dietary-accommodating menu options.

Menus, availability and service areas may change from time to time. Descriptions and images on our website are indicative; the confirmed menu in your quote or booking applies to your order.

3. Quotes, Orders and Bookings

  • Quotes are valid for 14 days unless stated otherwise and are based on the guest numbers, menu and event details you provide to us.
  • A booking is confirmed only when we receive your signed quote or written confirmation together with any required deposit.
  • For events, final guest numbers and menu selections must be provided at least 72 hours before the event unless we agree otherwise in writing.
  • You confirm that all information you give us (including dietary requirements, venue access, timings and site conditions) is accurate and complete.
  • Table bookings are held for a reasonable period after the reserved time; please let us know if you are running late via the contact details in your confirmation.

4. Pricing, Payment and GST

  • All prices are in Australian dollars and include GST where applicable, unless your quote states otherwise.
  • Deposits may be required to secure catering and event bookings. The deposit amount and payment schedule will be set out in your quote.
  • Unless your quote states otherwise, final payment for catering and events is due within 7 days of invoice, and for dine-in and takeaway at the time of service.
  • We may pass on reasonable additional costs caused by changes you request after confirmation (for example, increased guest numbers or venue delays).
  • Overdue amounts may attract interest and reasonable recovery costs to the extent permitted by law.

5. Cancellations and Changes

  • If you cancel a confirmed catering or event booking, we may retain the deposit and, where the cancellation occurs within 7 days of the event, charge reasonable costs already incurred for food, staffing and preparation.
  • Reducing guest numbers within 72 hours of an event may still be charged at the confirmed number or the minimum stated in your quote.
  • If we must cancel or materially change a booking for reasons within our control, we will offer an alternative date, an equivalent substitute or a refund of amounts paid for the un-supplied Services.
  • Dine-in bookings may be cancelled free of charge by contacting us before the reserved time.

6. Allergens, Dietary Needs and Food Safety

Our kitchen handles nuts, shellfish, gluten, dairy, eggs, sesame and soy, and while we take reasonable precautions, we cannot guarantee the complete absence of allergens or cross-contamination. If you or your guests have severe allergies, please tell us in writing before ordering so we can advise what we can safely provide. Menu items described as vegetarian, vegan, gluten-free or similar are prepared with reasonable care to that description.

We comply with the Food Act 2008 (WA), the Australia New Zealand Food Standards Code and applicable food safety requirements. Food is prepared for consumption on the day of service unless we advise otherwise; we are not responsible for deterioration caused by improper storage, transport or handling after handover to you.

7. Alcohol Service

Where alcohol is served, it is provided in accordance with the Liquor Control Act 1988 (WA) and our liquor licence conditions. Alcohol is served only to persons aged 18 years or over; photo identification may be requested. We practice responsible service of alcohol and reserve the right to refuse service. Persons under 18 must be accompanied by a responsible adult where alcohol is present at licensed events.

8. Delivery and Catering Logistics

  • Delivery and service times are estimates; we aim to arrive and serve within the window confirmed in your quote, subject to traffic, weather and venue access.
  • You are responsible for providing safe, lawful and adequate access to the venue, including parking, power, water and sufficient working space where agreed.
  • Equipment we provide remains our property and must be returned in the condition supplied; fair wear and tear excepted.
  • Leftover food becomes your responsibility at handover; we provide food-safety handling notes on request.

9. Consumer Guarantees Under Australian Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or equivalent State legislation, including the Fair Trading Act 2010 (WA), which cannot be excluded, restricted or modified.

In particular, the Services we supply come with guarantees that they will be provided with due care and skill, be reasonably fit for any purpose you made known to us, and be supplied within a reasonable time. Goods we supply (including food and beverages) come with guarantees that they are of acceptable quality and reasonably fit for purpose. If a consumer guarantee is not met, you may be entitled to a remedy, such as a refund, replacement or re-supply, as set out in the Australian Consumer Law.

10. Limitation of Liability

To the maximum extent permitted by law, and subject always to section 9, our total liability to you for any claim arising out of or in connection with these Terms or the Services is limited, at our option, to the supply of the Services again or the payment of the cost of having the Services supplied again.

We are not liable for indirect or consequential loss (including loss of profits, enjoyment or opportunity) arising from the Services, except where such liability cannot be excluded by law. This section does not limit liability for death, personal injury or loss caused by our negligence where such liability cannot lawfully be excluded.

11. Use of This Website

You may use our website for lawful purposes only. You must not attempt to interfere with the website, gain unauthorised access to our systems, scrape or reuse content for commercial purposes without our written consent, or submit false, misleading or abusive material through our forms. Website content is general information about our Services and is subject to change; it is not a binding offer, and the confirmed quote or menu applies to your order.

12. Intellectual Property

All content on this website, including text, menus, images, logos and the Chilli House name, is owned by or licensed to Chilli House Pty. Ltd. and is protected by Australian and international copyright and trade mark laws. You may view, download and print pages for personal, non-commercial use only. Any other reproduction or use requires our prior written permission.

13. Third-Party Platforms and Payment Providers

Where you order or pay through a third-party platform, delivery partner or payment provider, that provider’s own terms and privacy policy also apply to your transaction. We are not responsible for the acts, omissions or service levels of third-party providers, except where we have engaged them as our subcontractor in supplying the Services to you.

14. Privacy

We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which forms part of these Terms. Information you provide for bookings, quotes and dietary requirements is used to supply the Services and for related purposes described in the Privacy Policy.

15. Events Outside Our Control

We are not liable for delay or failure to perform the Services where caused by an event outside our reasonable control, including natural disasters, severe weather, fire, flood, power or utility failure, public health directions, industrial action, supplier shortages or other force majeure events. Where possible, we will notify you promptly and offer a rescheduled date or refund for Services not supplied.

16. Changes to These Terms

We may update these Terms from time to time. The version published on this page at the time you place an order or make a booking applies to that order or booking. Material changes affecting confirmed bookings will be communicated to you before the event.

17. Governing Law and Disputes

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, and you and we submit to the jurisdiction of the courts and tribunals of Western Australia.

If you have a dispute, please contact us first so we can resolve it fairly and promptly. You may also seek information or assistance from Consumer Protection within the Department of Mines, Industry Regulation and Safety (WA) or another appropriate consumer affairs body.
